Driver in deadly bicycle accident not indicted

A Scioto County grand jury has decided not to indict a woman in the death of 22-year-old Shawn R. Hamilton, a bicyclist that was struck by a car on Ohio 522 in December of 2012.

“The grand jury did not indict her,” Ohio State Highway Patrol Portsmouth Post Commander Lt. Karla Taulbee told the Daily Times Tuesday afternoon. “He (Scioto County Prosecutor Mark Kuhn) called me about an hour ago.”

According to the Taulbee, the driver of the 2006 Buick Rendezvous involved in the accident came forward two days after the incident. Kuhn reported in January (2013) that his office was awaiting statements from additional witnesses in the case and no determination had been made as to whether the woman’s case would be taken to the grand jury.

The grand jury chose not to indict the woman after seeing the evidence from the Prosecutor’s office.

“He has spoken to the mother,” Taulbee said. “So she is aware of it.”

Hamilton was struck while riding his bicycle and later died at Cabell Huntington Hospital in Huntington.

Kuhn was not available for comment at press time.
