Grand jury does not indict Staker in shooting

A Scioto County grand jury has refused to return an indictment in the case of Tyler Staker, 22, of Portsmouth, who had been involved in the shooting death of Steve Holsinger, 33, of 9550 Old Gallia Pike, Wheelersburg, on July 12, 2012.

Staker, who along with his father, Robert Staker, had gone to Holsinger’s residence to repossess a piece of equipment that was purchased from their business they say had not been fully paid for, reportedly shot Holsinger after a verbal confrontation.

According to the sheriff’s report, Staker and his father had been at the location for over an hour knocking on the door in attempts to get Holsinger to return the equipment. The report goes on to say Holsinger came out onto the porch at approximately 10:20 p.m. with a gun in his hand and very upset.

A witness told detectives that he did put the gun into his pocket for a short time, then got upset and pulled out the gun telling Staker and his father they had three seconds to get off his property. Holsinger then reportedly raised the weapon pointing it at Staker’s face. It was then, according to the report, that Tyler Staker shot the deceased several times.

“The grand jury did not have enough votes to return an indictment,” Scioto County Prosecutor Mark Kuhn said. “In Ohio there’s nine members of the grand jury and it takes seven of those members to find an indictment.”

Kuhn said the grand jury heard from eight witnesses, reviewed a large number of photographs taken at the scene the night that it happened and all of the evidence collected by the Scioto County Sheriff’s Office including phone calls and financial records regarding the equipment in question.

“On this case they (grand jury) spent approximately six and a half hours hearing testimony, reviewing records and documents, and deliberating,” Kuhn said. “That is about the longest that a grand jury has spent in the eight years that I have been the prosecutor. It wasn’t a decision they reached lightly. It was one they spent a lot of time on.”

Kuhn said neither side of the confrontation acted in the manner they should have, given the circumstances.

“I certainly wouldn’t view this as an endorsement of how the Stakers acted up there in trying to recover this lawnmower,” Kuhn said. “In the same sense it’s not an endorsement of the way the homeowner came out acting with a gun, sort of escalating that either. Because of that, it’s a case that, as a prosecutor, you would have liked to have something else to show a grand jury one way or the other. It was the kind of case that lent itself to people looking at the facts and having a difficulty making a decision.”

Kuhn said the first people he notified when he saw the outcome of the grand jury were Holsinger’s family members.

“They are really good people and they are having a hard time right now,” Kuhn said.

Kuhn was asked what people should do under similar circumstances to prevent escalation that obviously occurred that night.

“The easy thing for both sides to have done in this case was to call the sheriff,” Kuhn said. “It’s Porter Township. We’ve got township deputies around the clock. The easy thing for either side to have done would have been to call the sheriff. When Steve Holsinger was finally told by a neighbor that they were going to call the sheriff. That’s sort of what prompts him to go out with a gun. That should have been the time to say, ‘yes, get the sheriff here.’ or if those fellows are entitled to their mower, to go and get a court order. It’s not that hard.”

Early controversy in the case occurred when no arrest was made at the scene. However, Scioto County Sheriff Marty V. Donini said his deputies followed protocol and called Kuhn, asking for his advice. He did not advise them to make an arrest at that time.

you know the goons at mark kuhns office put me in prison for 3 years for saying i wanted to beat someone up in a bar and the guy was not even there guess i dont have the right last name meanwhile a woman run a red light doped up and killed my nephew guess what shes not in jail guess shes got the right one

While I find this entire situation very sad, no one seems to be addressing the subject of personal responsibility on the part of mr. Holsinger. When I make a purchase, I agree to pay for that item. If for some reason I cannot make payments, I would try to make every effort to let the business know that I would make some kind of payment, even if it's $10.00 a month. If I can't afford it, I don't buy it! Pretty simple concept!!

It is scary to know that someone can come to my house with a gun, shoot me for a lawnmower and get away with it because somebody "unbiased" gave a "compelling" statement about the crime.

I agree election is comming and it is time for a change. When you can go onto someone else property and beat on their doors and home for two hours and then when they come out with a weapon and tell you to leave and you shoot them dead on their own property and the sheriff office says it is a justified shooting there is a problem These people went there for trouble now a man is dead. It could all have been avoided if the stakers had went through the court for the money they said they were owed like other people do. Shame on the people who handled this case from the start. Justice was not served.

You are just what you label says, very funny.

All you got to do is watch some of those detective shows and see how they can handle Grand Juries, then you will wake up, but we doubt it, for you had an agenda to come on here and post, not reality, justice or the Truth. Sorry for you bad luck.

This is a pathetic situation. Staker should have been arrested at the time of the murder! A name should NEVER give people the right to kill someone in their own yard. Election time is coming up and I hope the citizens of Scioto County remember this!! We have the POWER tomake changes!!

How do you change a position when there is no replacement to vote for like County Solicitor, your key person, the sheriff checked with him on the arrest or not, you only unseat them when the "gang" brings in an outsider like they did City Solicitor Jones who came in town, bought Crispie Cream, set up a law office, and beat Solicitor Kuhn, the other Kuhn. :)

Yeah you have power don't you, what's that prayer, that ends, and give me the power to tell the difference between what I can control or not? You don't Tu. You don't, have any power, only in your mind. All you can do is rant and rave, claiming you do, power to the people, yeah, lets see you getting the replacement candidates like the CAVER's do do.

yes ConcereneTu... I agree with you..my husband ran into a sheriff from another county and he was told that yes he should been arrested! I have also heard from a very good source...that you cant claim self defense if you provoked the situation...I also was told that there wasnt security interest involved and they shouldnt been there to begin with....crimes commited before the shooting and wasnt even charged with that! Yes all needs to remember in November! Time for changes in Scioto County!

The Grand Jury only hears the "story" from the Prosecutor and the Sheriff's Office. It is presented to be slanted in the direction THEY want it to go. NO ONE but their side is presented and it can be presented anyway, no one can see or hear the testimony that I know of. When I asked to have the record of one thru the Ohio Public Information Act. I was denied. IT is NOT without Bias. I have compassion for both sides, and whereas I do not believe Staker should spend the rest of his life in prison, I do not believe he should be able to walk just because of his name and his relationship with the "powers that be" in Scioto County. He made a mistake and should have to pay something. The scales of justice is not equal in Scioto County. If we want it changed WE are going to have to be the ones to change it. The Judges and Prosecutor and the Sheriff All needs to have some fresh and unbiased people in there. Wake up Scioto County. If I were the Holsingers I would slap Stakers with a wrongful death suit and they would pay one way or another. Bring suit against Scioto County for causing them pain and suffering also if I could - hit them where it hurts in their pocket book.

I agree NursPract 100% this whole situation has been handled badly on all sides , there should not be a young man dead when it is all said and done and his family should most certainly hire lawyers from out of town to handle their case and file a wrongful death suit against those parties.

that is not true they hear every side of the story I know that 100 percent.Let me guess this is Lisa stirring up the pot, why don't you open up your eyes adn see what the family is going through and realize that the jurors made this decission not Mark Kuhn not the officers and not the Sheriff. You want to say if he wsa arrested that night well the facts are he would have bonded out and the grand jury would have made the same decesssion then some attorney would be after the officer for a wrongful arrest so see they cant win.Everybody is quick to judge without knowing all the facts which is typical for people in Scioto County.

yes...that is how we see it....the prosecutor didnt do the job right. It was told he wasnt going to get into collections with the grand jury and I dont believe that was right either because this is where it all stemed from from the start. I dont believe the jury got the whole complete story...because of who knows who...and its not right or fair...who cares for the victims anymore?? Yes, Staker should had got something...the prosecutor told me about a month or so ago...he will get something but didnt know what...I wasnt the only one in the room when this was said...about 3 others with me! Oh so not true ...not right and not fair!!! Changes need made in this county....your right....ones that it dont matter who you are..the laws are set for everyone...not just ones singled out! He shoul been arrested that night for crimes before the shooting!

Had proper protocol and laws been followed in the first place, the Stakers should have left the property long before Mr. Holsinger brought a gun into the mix. Under the law, you cannot create a disturbance and when told to leave, you must leave. By both Stakers not doing that, it led to an escalation of the incident.

A no Bill by a grand jury is not a "not guilty" and double jeopardy does not apply here, no?

Also, there is no Statute of Limitations for Murder is there, In Ohio. ???

I think most people know the name saved his butt. This grand jury should have never heard this case. It should have been moved to a different locality. This was never suggested to my knowledge. This mess is a blackeye on Donini and Khuns office, just remember that this November.

So now Donini makes a suggestions of where to hold court venues? I have a feeling that you are the same type of person that when the team you are rooting for loses, you blame the refs!

Is everyone seriously setting here and telling me that the Stakers bought the members of the grand jury? Is a lawn mower repair shop that successful that they can pull some Al Capone type crime? Can anyone stand up and say that the law worked? Although it is widely unpopular, the law is unbiased and did not lean towards the court of public opinion. Take a good look at yourselves and then hopefully you can figure out why this country is in the shape it is!

TRAVESTY!!! The shooter should at least be charged with manslaughter and treaspassing. How could this happen that a grand jury would not find that a crime had been comitted???? The victims family should sue the shooter for the loss of their loved one. His children now have no father such a sad sad day here in our county.

Its all about name and money in this town....there was 2 shootings after steve's and those was arrested...where is our justice at????????? Most all in Scioto County knows!! we dont need to tell them....all knows its a good ole boy network in this county!

This is very sad news. The Staker family/business did NOT have the right to be at that home for that length of time nor at that time of night. The widow needs to find a good lawyer and go after the Staker business in a civil court. At least get some money to take care of the fatherless children.

if the victom where black do you think it would have made a difference? if the young staker was shot, would mr. holsinger been arrested? look at all the drug dealing that takes place in scioto co. and it goes on and on.your votes can make it change. those with money will always pray on those without. how proud the young stakers father must be of him....

This is a sad and horrible thing that happened and doesn't seem at all fair that the shooter isn't even going to go to trial, however, this was the decision of the grand jury not the decision of the Sheriff or County Prosecutor. I don't agree that they are to blame.

The BIG QUESION is Why didn't the young man or his wife call the sheriff's office for help? That is a question nobody will ever know!!!

Maybe the case should have been heard from a grand jury far from this county to make sure that there wasn't any bias in the final decision due to knowing the family involved!!!

I cannot believe that people have a problem with their peers deciding not to prosecute. It is not Mark Kuhn or Marty Donini's decision. This is called due process. It is our constitution! It does not matter if you are in Scioto Co. or anywhere in the U.S., this is the process. I am glad for one thing out of this whole situation, the court of public opinion was not upheld!
