Former Adams County deputy pleads guilty to unlawful sexual conduct with a minor

A former Adams County Sheriff’s Deputy has plead guilty to one count of unlawful sexual conduct with a minor where he was 10 or more years older than the victim. Hamilton County Prosecutor Seth Tieger, who served as the visiting prosecutor in the case said the victim was a 15 year old female and McCarty was around 47.

McCarty reportedly admitted to drugging and performing a sexual act on the 15 year old.

The allegation as it was presented by the prosecutor in court in Adams County featured graphic details of the sexual conduct and that his DNA was found in the victim’s underwear.

“When they interviewed him he had said he had a sexual fetish for women’s underwear,” Tieger said.

Tieger said McCarty has been held without bond in the Brown County Jail since he was arrested in February 2015. Shortly after being arrested McCarty resigned from the Adams County Sheriff’s Office.

Tieger said McCarty will return to court for sentencing on Oct. 26, 2015 at 2 p.m. The potential penalty is from 12 to 60 months.

“The victims are going to be asking for a penitentiary sentence and the defendant is going to be asking for probation,” Tieger told the Daily Times. “It will be left up to Judge Scott Gusweiler of Brown County who covered the plea as a special judge. The sentencing will 100 percent be left up to him to decide what’s fair.”

Tieger said McCarty will be declared a tier-2 sex offender which means he will have to register as a sex offender twice a year for the next 25 years.
